1. Acceptance of Terms

By accessing or using the Chattsy platform (“Service”) provided by Chattsy (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

These terms apply to all users of the Service, including administrators, agents, and visitors who interact through the chat widget.

2. Definitions

• Service — The Chattsy live chat and shared inbox platform, including the web application, API, chat widget, and mobile application.
• Account — Your registered account on the Chattsy platform.
• Organization — A workspace within Chattsy that contains team members, widgets, conversations, and settings.
• User — Any person who creates an account or is invited to an organization.
• Visitor — An end user who interacts with the chat widget on a website that uses Chattsy.
• Content — All text, files, data, and other materials uploaded to or generated through the Service.

3. Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, including your password and any multi-factor authentication methods.

You are responsible for all activity that occurs under your account. If you become aware of any unauthorized use of your account, you must notify us immediately at [email protected].

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

4. Service Usage

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the Service, other accounts, or any related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to send spam, unsolicited messages, or engage in phishing.
• Upload or transmit malware, viruses, or any other malicious code.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute the Service without written permission.

We reserve the right to suspend or terminate your account if you violate these terms or use the Service in a manner that we determine, in our sole discretion, to be harmful or disruptive.

5. Payment & Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.

• All fees are charged in advance on a monthly or annual basis.
• Prices are listed in USD, INR, and EUR. Your billing currency is determined by your country.
• Payments are processed securely through Razorpay. We do not store your payment card details.
• You are responsible for paying any applicable taxes.
• Fees are non-refundable except as described in our Refund Policy.

6. Cancellation

You may cancel your subscription at any time from your billing settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• After the billing period ends, your organization will be downgraded to the Free plan.
• Your data will be retained according to our data retention policies.
• You can resume your subscription at any time before the billing period ends.

7. Intellectual Property

The Service, including its design, code, features, and documentation, is the intellectual property of Chattsy and is protected by copyright and other applicable laws.

You retain ownership of all Content you upload to the Service. By using the Service, you grant us a limited license to store, process, and display your Content solely for the purpose of providing the Service.

“Chattsy” and the Chattsy logo are trademarks of Chattsy. You may not use our trademarks without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Chattsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated terms on our website and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the updated terms.
